Case Evaluation, Expert Witness Testimony, and Insurance Case Review
A. CASE EVALUATION SCREENING REPORT (NON-TESTIFYING)
In the selection of this service, I will review your case in a cost-effective way to quickly determine if the case has merit and to identify its possible strengths and weaknesses at the earliest stage. This is often the fastest way to know if this is a case that you want to accept. You will have a better understanding of your case with no obligation to retain me for additional services. I will review your case and determine its merit based on the applicable standard-of-care in dentistry and any deviations from those standards. An opinion will be presented as to occurrence of and breach of the standard-of-care such as malpractice or negligence. The strengths and weaknesses of your case will be assessed and recommendations will be made including basic strategy and tactics. As this option provides only a written screening report, no signed document will be provided but by mutual agreement you will have the opportunity to retain me for additional expert witness services including drafting of an in-depth case evaluation and production of a signed report or affidavit to accompany your initial filing should the case have merit.
B. IN-DEPTH CASE EVALUATION AND ANALYSIS (NON-TESTIFYING)
If the case has merit, I will provide only a detailed, in-depth written case evaluation. An option will be provided for release of a signed report or affidavit to accompany your initial filing should the case have merit. By mutual agreement, you will have the opportunity to retain me for additional expert witness services. You will receive a comprehensive report which will include a determination of your case's merit and an identification of applicable standards of care and deviations, if any, and a determination for the likelihood or absence of negligence and dental malpractice. If the case has merit, this work-product report will include: 1) in-depth opinion of the case with an identification of the applicable standard-of-care in Dentistry and subsequent deviations from those standards, 2) a detailed analysis of strengths and weaknesses of your case, 3) suggested strategies and tactics, and the 4) identification of the need for additional dental or medical expert witnesses in a particular specialty. Further, 5) issues including causation, proportionate liability, and potential damages will be reviewed where applicable. 6) A mutually agreed number of specific questions presented by counsel will be thorougly addressed. In addition, 7) two, twenty minute telephone conferences with counsel is included to clarify my findings and improve your interpretation and understanding of the work product report. You will have no obligation to retain me for additional services.
C. EXPERT WITNESS (requires retainer agreement and billed at hourly rate)
This option requires an executed retainer agreement. All services will be be billed at my hourly rate and other charges and expenses will be assessed as per my expert witness fee schedule attached to the agreement. I will review records and render an opinion on the merits of your case and will be available to appear in depositions or court to provide testimony. I will advise and assist counsel in all stages of litigation as requested. A signed report or affidavit to accompany your initial filing is available as well should the case have merit.
D. INSURANANCE CASE REVIEW AND OTHER SERVICES (requires retainer agreement and billed at hourly rate)
This service is to review records to determine insurance tort-liability and to review appropriateness of treating or consulting dentists' cost estimates. I will produce estimates for dental treatment costs in the case of trauma, accident, or act of dental malpractice.
